Privacy Notice
The companies Manpower SA with headquarters in Rue du Sablon 2, 1110 Morges, and Experis AG based in Wasserwerkstrasse 10, 8006 Zürich, as Data Controllers (“Data Controllers”, “we/us”, “our”), hereby provide the following information, in compliance with Swiss and European data protection legislation, in particular the General Data Protection Regulation (“GDPR”), and the Swiss Federal Act on Data Protection (“FADP”), regarding the use of personal data (“Data”), collected from candidates applying for open job positions managed by the Data Controllers.
A. PROCESSING PURPOSES AND LEGAL BASIS
We process your name, surname, email address and/or phone number only for the purpose of contacting you and collecting the work reference of your former employees or of ManpowerGroup candidates that you may have known for other reasons.
The processing of your Data is necessary for the purposes of the legitimate interests pursued by the Data Controllers, as permitted under Applicable Laws according to Art. 6 (1) (f) GDPR.
If we intend to use your Data for any other purpose which is incompatible with the purpose for which the Data were originally collected, we will inform you in advance.
B. DATA PROCESSING
Your Data will be processed by our employees as part of their functions and in compliance with the instructions received, always and solely for achieving the specific purpose indicated in this privacy notice, and in accordance with the principles of fairness, lawfulness, and transparency, as required by Applicable Laws.
In performing their processing operations, the Data Controllers undertake to:
- guarantee the accuracy of processed data and implement any corrections and/or additions requested by the data subject.
- adopt security measures to ensure adequate data protection, considering the potential impact of the processing operations on the respect for the data subject’s rights and fundamental freedom.
- inform the data subject, according to applicable legal requirements of any violations of personal data.
- guarantee that processing operations comply with applicable legal requirements.
C. DATA DISCLOSURE
Our employees who need your Data to perform their duties or because of their position, or other entities that provide services for the Data Controllers and have been specifically appointed as Data Processors or Persons in charge of Data Processing, will only have access to your Data in relation to their obligations. We will not disclose your Data to any person who has no right to receive it.
Your Data will not be transferred outside the EEA.
D. RETENTION PERIOD
Your Data will be available for the Data Controllers for up to twenty-four months and then be deleted automatically.
E. EXERCISE OF RIGHTS
When permitted by Applicable Laws, a data subject can exercise, particularly under Art. 15 to 22 of the GDPR the following specific rights:
- Right of access: The data subject has the right to access the personal data regarding him or her that are being processed to check whether his or her personal data have been processed in compliance with the law.
- Right to rectification: The data subject has the right to obtain the rectification of any inaccurate or incomplete data regarding him or her to ensure the accuracy of such information based on the purposes of the processing operations.
- Right to erasure: The data subject has the right to request that the Data Controller erase information regarding him/her and no longer process such data.
- Right to restriction of processing: The data subject has the right to request that the Data Controller restrict the processing of his or her data.
- Right to data portability: The data subject has the right to receive personal data in a structured, commonly used, and machine-readable format and has the right to transmit those data to another Data Controller.
- Right to object: The data subject has the right to object to the processing of his or her data in the cases referred to in the GDPR, at any time and with no need to justify his/her decision.
- Right not to be subject to automated individual decision-making: The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her, or similarly significantly affects him or her.
- Right to lodge a complaint with a supervisory authority: A data subject may have the right to lodge a complaint with an applicable data protection supervisory authority; in the EU Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal information relating to him or her infringes GDPR.
