Privacy Notice for Candidates and Referees in accordance with the Israeli Privacy Protection Law and Regulations

The companies Manpower Israel Ltd. and Experis ITS Ltd., and their Israeli subsidiaries with headquarters in 110 Yigal Alon St., Tel-Aviv (the “Companies”), as the Database Owners (the “Owners”), hereby provide the following information, in compliance with the Israeli Privacy Protection Law, 5741-1981, and the regulations that have and/or shall be enacted by virtue thereof (“PPL”), regarding the use of your personal data (hereinafter “Data”), collected from the candidates who applied for open job positions managed by the Owners and their referees through the RefApp system.

 

A. PERSONAL DATA PROCESSING PRINCIPLES

The PPL establishes the rules on the protection of natural persons with regard to personal data processing. It protects the fundamental rights and freedom of natural persons and especially their right to personal data protection. Data will be collected only as far as compatible with the purposes described in the following paragraph and their processing will be based on the principles of fairness, lawfulness and transparency.

 

B. PROCESSING PURPOSES AND CONSENT

Data (name, surname, email address and/or phone number) will be processed only for the purpose: (i) if you are a candidate, to receive your referees Data (after such referee has given you their consent, as further detailed in Section H); or (ii) if you are a referee, to contact you in order to collect the work reference of your former employees or of ManpowerGroup candidates that you may have known for other reasons.

As a candidate, the processing of Data by the Companies for the purpose above is necessary for the purpose of your potential employment by the Owners, and by providing your contact details and CV to the Companies you consent to such use.

You are under no legal obligation to provide the Companies with Data about yourself. By submitting the Data at your own free will, you agree that the Companies will use it as detailed in this Privacy Notice or to assess your suitability for the position to which you have applied as a candidate or to contact you as a referee of a candidate.

For candidates, the Owners may use your email address, which you provided us to contact you, when necessary, including in order to send you reminders, offers and to provide you information and notices about job offers. At any time, you may choose (opt out) whether your personal information is to be used for sending such marketing materials. If the Companies intends to use the Data it has collected for any other purpose which is incompatible with the purpose for which the Data was originally collected, the Companies will inform the data subject in advance.

 

C. DATA PROCESSING METHODS

Data may be processed by the Owners, both manually and using IT methods and procedures.

In our Companies, Data is processed by employees and staff as part of their functions and in compliance with the instructions received, always and solely for achieving the specific purpose indicated in this Privacy Notice.

Data is not disclosed to employees that do not have a need to know such personal data.

In performing their processing operations, the Companies undertake to:

  • guarantee the accuracy and updating of the processed Data, and promptly implement any corrections and/or additions requested by the data subject;
  • adopt security measures to ensure adequate data protection, taking into account the potential impact of the processing operations on the respect for the data subject’s rights;
  • guarantee that the processing operations comply with applicable legal requirements.


D. SECURITY

  1. The Owners take the safeguarding of Data very seriously, and use a variety of methods to try to protect the Data from loss or unauthorized use or access when it is in the Owners’ possession or control, including reasonable technical and organizational measures that restrict access to the Data. However, the Owners do not promise or guarantee that Data will be fully protected from unauthorized disclosure or use.
  2. The Owners also regularly monitor their systems for possible vulnerabilities and attacks, and regularly seek new ways for further enhancing the security of the services and protection of your privacy.
  3. You should take steps to protect against unauthorized access to your passwords, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. In addition, you should take steps to protect against unauthorized access to Data stored on your devices as well as defining limited access rights to such Data on a need to know basis.

 

E. SCOPE OF PERSONAL DATA CIRCULATION AND DISCLOSURE

The employees of the Owners who need the Data to perform their duties or as a result of their position, or other entities that provide services for the Owners and have been specifically appointed as persons in charge of Data processing, may have access to your Data. Such persons, in relation to their duties will only have access to Data related to their job.

 

The recruitment data collection process is performed by the Companies through a third party cloud based service abroad. Data may also be shared, if required for the purposes hereunder, with other Manpower Group entities.

 

Your data will not be transferred outside the EEU or Israel.

 

F. RETENTION PERIOD

Your Data will be available for the Owners for different periods, depending on the purposes for processing the Data, as well as pursuant to legal requirements under the applicable law and will then be deleted automatically.

 

If you provide Data for a specific job application, the Companies will retain such Data until such job position is filled, unless required to be retained under the applicable law.

 

If you provide Data to be included in the Companys’ databases, the Companies will retain such Data until you request such Data be deleted, unless required to be retained under the applicable law.

 


G. EXERCISE OF RIGHTS

According to the PPL (articles 13-14), the data subject may exercise the following rights vis-à-vis the Owners:

 

  1. Right of Access: The data subject has the right to access the personal data regarding him or her that are being processed in order to check whether his or her personal data have been processed in compliance with the law.
  2. Right to Rectification: The data subject has the right to obtain the rectification of any inaccurate or incomplete data regarding him or her in order to ensure the accuracy of such information.

 

H. CONSENTS

  1. By providing Data to the Owners, you hereby give your consent to be bound by the terms of this Privacy Notice.
  2. You hereby give your consent to the Owners to store Data as part of their database for candidates and offer you jobs that may fit your qualifications and experience.
  3. You hereby give your consent, on behalf of your referees (who have given you their consent), to provide the Owners with your referees’ contact information and any other data as provided by you so they will be contacted on your behalf and that such personal data will be stored through a third party cloud based service abroad.
  4. As a referee, you hereby give your consent to the candidate to provide the Owners with your Data and as such, you give your consent to the Owners, to process your Data in accordance with this Privacy Notice.
